What is Unfair Dismissal?

 

‘Unfair Dismissal’ refers to the act of terminating employment by using any kind of unfair means. It is also denoted as ‘unjustifiable dismissal’ in the USA.

 

In case an employee gets dismissed unfairly, they can approach the employee tribunals, who preside over the cases and consider whether the dismissal was just and fair. If the company is found to have terminated the individual’s employment unfairly, they are asked to justify their reasons and necessary actions are taken against the employer.

 

Although it is easy to discuss the fundamentals of unfair dismissal, it is important to note that the actual case needs to be studied and several pieces of evidence are considered before the employment tribunals furnish a judgment.
